In the context of globalization and active labor migration, more and more foreigners are seeking employment opportunities outside their home countries. One of the key documents required for legal employment of a foreigner in Ukraine is a work permit. This document provides a legal basis for foreigners to work in the country, allowing them to obtain a temporary residence permit and a visa for long-term stay.
A work permit for a foreigner in Lviv is an official document issued by the State Employment Service or other authorized bodies, allowing a foreign citizen to legally work in Ukraine. This document is a mandatory requirement for the legalization of foreign labor, both for the employer and the employee.
A work permit is required for all foreigners intending to work in Ukraine. This includes both skilled workers and members of management or investors who plan to develop a business in the country. Exceptions may apply to citizens of certain countries that have specific agreements with Ukraine, but the vast majority of foreign nationals must obtain this document.
The procedure for obtaining a work permit in Lviv is clearly regulated but requires careful attention to each stage:
Submitting an Application by the Employer: The employer planning to hire a foreigner must apply to the local office of the State Employment Service or another authorized body to obtain a work permit for a specific employee.
Document Package: The application must be accompanied by a set of documents, including: a copy of the foreigner's passport; two color photographs (3.5 x 4.5 cm); a draft employment contract; documents confirming the foreigner’s education and qualifications (diplomas, certificates, etc.); and proof of payment of the state fee for the permit.
Application Review: Once the documents are submitted, the authorized body will review the application within 7–10 business days and issue a decision to grant or deny the permit.
Receiving the Permit: If approved, the foreigner can receive the work permit, which allows them to sign an employment contract with the employer.
A work permit is usually issued for up to one year, but it can be extended if needed. For highly qualified specialists or top-level managers, the validity may be up to three years. To extend the permit, the employer must apply no later than 30 days before the current permit expires.
Visa Eligibility: Based on a work permit, a foreigner can obtain a long-term D-type visa, which allows legal long-term stay in Ukraine. This visa enables the foreigner to work, study, or engage in other activities without the need to constantly leave the country.
Temporary Residence Permit: After obtaining the work permit and a D-type visa, a foreigner has the right to apply for a temporary residence permit in Ukraine. This document allows legal stay in the country for the entire term of the employment contract and also grants freedom of movement within Ukraine.
Legal Employment: A work permit ensures the protection of the foreigner’s labor rights and allows for official employment with access to social benefits and guarantees provided under Ukrainian law.
Possibility of Contract Extension: A foreigner with a work permit can extend their employment contract with the employer if both parties are satisfied with the collaboration. This allows the permit and residence to be prolonged, ensuring uninterrupted legal stay in Ukraine.
An employer planning to hire a foreign worker should keep in mind several key aspects. Firstly, the employer is responsible for ensuring that the foreigner works legally under a valid work permit. Secondly, if the foreigner resigns or ends the employment relationship, the employer must notify the relevant authorities within three working days. If needed, the employer can initiate the process of obtaining a new permit for another foreign employee.
